SMS Terms of Use
Defined Terms
“Firm” refers to Bearstone Law, PLLC, located at 12800 Westridge Blvd. Ste. 141, Frisco, Texas 75035.
“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“SMS Terms” refers to these SMS Text Messaging Terms of Use.
“Text Message Service” includes any arrangement or situation in which the Firm sends one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
Opt-In Consent to Text Messaging
By Opting In or otherwise utilizing the Firm’s Text Message Service, you agree to be bound by these Text Messaging Terms of Use (“SMS Terms”), as well as the Firm’s general Terms & Conditions and Privacy Policy, which are hereby incorporated into these SMS Terms by reference.
E-Sign Disclosure
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
Text Message Service Privacy Policy
The Firm holds your privacy with the utmost respect and care. The Firm uses information you provide through this service only to transmit your mobile messages and to respond to you. This includes, but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist the Firm in the delivery of mobile messages.
Mobile information will not be shared with third parties for marketing purposes. However, the Firm reserves the right to disclose any information if necessary to satisfy any law, regulation, or governmental request, to avoid liability to you or others, or to protect the Firm’s rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn’t intended to modify the Firm’s general Terms and Conditions or Privacy Policy (incorporated by reference above), as these may govern the relationship between you and the Firm in other contexts.
Description of Intended Use and Message Types
When you opt in to receive text messages from the Firm, you agree to receive text messages containing information related to your legal matter and/or the Firm’s legal services. A few examples include the following:
(a) Client intake, consultation, scheduling, appointment confirmations, reminders, and updates
(b) Case status notifications
(c) Document or information requests
(c) Billing notices and payment confirmations
(d) Compliance notices and required disclosures
(e) Messages about prospective legal services, Firm events, and general announcements
Frequency of Text Messages
This Text Messaging Service is for conversational person-to-person communication between you and the Firm. The Firm may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on the nature of your legal matter and whether you take steps to generate more text messages from the Firm (such as by sending a HELP request).
Costs of Text Messages
The Firm does not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

SMS Text Message Carrier Disclosure
Neither the Firm nor wireless carriers are not liable for messages that are sent but are delayed or undelivered. You acknowledge that message delivery is subject to effective transmission by your carrier and is beyond the Firm’s control.
Authorization & Eligibility
By Opting In, you represent that you are the owner or authorized user of the mobile phone number you provide and that you are at least 18 years old.
Data Collection and Use
The Firm collects and uses information as described in our general Privacy Policy. This includes your mobile number, message content, and related metadata for the purposes of delivering messages, maintaining program records, and providing legal services.
Opting Out of Text Messages
If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation. After unsubscribing, the Firm may send you confirmation via text message.
Changes to These Terms of Use
The Firm may update these SMS Terms from time to time. Changes are effective upon posting on the Firm’s website. Your continued participation constitutes acceptance.
Legal Services Not Conditioned Upon Participation in Text Messaging Service Program
Your consent to participate in the Firm’s Text Messaging Service is not a condition of obtaining legal services. You may always contact the Firm by phone, email, or in person to engage the Firm’s services without Opting In.
Dispute Resolution and Governing Law
In the unlikely event that a dispute arises from these SMS Terms, you agree that such dispute will be governed by the laws of the State of Texas, without regard to conflicts principles, and resolved in the courts of the State of Texas, unless otherwise agreed in writing.
